DUI charge in Phoenix can be classified as either “standard”, “extreme” or “super-extreme.” Its classification depends on earlier DUI’s (if any) and your blood alcohol concentration (BAC) at the time of your arrest.

BAC

Under 21: .00%

21 or older: .08%

Commercial: .04%

Jail Time:

First offense:  Jailed for not less than 10 consecutive days

Second offense: Jailed for not less than 90 days

1st Extreme DUI: Jailed for not less than 30 consecutive days

2nd Extreme DUI: Jailed for not less than 120 days

Fines:

First offense: Fined not less than $1,250

Second offense: Fined not less than $3,000

1st Extreme DUI:  Fined not less than $2,500

2nd Extreme DUI: Fined not less than $3,250

License:

First offense: License will be suspended for 90 days

Second offense: License will be revoked for 12 months

1st Extreme DUI: Llicense will be suspended for 90 days

2nd Extreme DUI: License will be revoked for 12 months

Aggravated: Jail not more that more than 2 years and license revoked for 3 years
